２ 一般職と特別職（１）地方公務員の種類
Article 3. The local public services shall be divided into the regular public service and the special public service.
ア 一般職……特別職以外の一切の職
イ 特別職……地方公務員法第３条第３項に列記された職① 住民による選挙、または議会の選挙・議決・同意を必要とする職Positions appointment to which requires public election, or the election, resolution or consent of the assembly of the local public body; （例：知事、議会の議員、副知事、監査委員、人事委員会委員、選挙管理委員会委員）Positions of the chairmen of the board of directors, directors and auditors of the local development works corporation;
② 臨時・非常勤の職 （例：審議会委員、臨時又は非常勤の顧問・参与・調査員・嘱託員、非常勤の消防・水防団員）Temporary or part-time positions of commissioners or members of commission or board (including council and other bodies of a similar nature) established by laws and orders, bylaws, regulations of the local public body, or rules fixed by agencies of the local public body
●Temporary or part-time positions of expert-adviser, consultant, investigators, non-regular staffs, and other positions of a similar nature;
●Positions of members of "Shobodan" (fire prevention corps) in part-time service and of the flood defense associations;
③ 自由任用職（例：地方公営企業管理者、企業団の企業長、都道府県労働委員会の委員で常勤の者長・議長などの秘書で条例で指定する者、特定地方独立行政法人の役員）
●Positions of the general manager of the local public enterprise and the director of the union of such enterprise;
●Positions of secretaries of the heads, the chairmen of the assemblies of the local public bodies, and the heads of other agencies of the local public bodies, as designated by bylaws;
（２）一般職と特別職の区分＝地方公務員法の規定は、一般職に属する全ての職員に適用される。 法律に特別の定めがある場合を除くほか、特別職に属する職員には地方公務員法は適用されない。

（３）その他
① 都道府県警察職員のうち警視正以上の者は、一般職の国家公務員である（地方公務員ではない）。 ② 公民館長は、常勤の者は一般職、非常勤の者は特別職である。 ③ 一般職の職員を引き続き特別職に任用する場合、その者が一般職を退職することが必要である。 ④ 民生委員は、非常勤特別職の地方公務員である。⑤ 国の指定統計調査の調査員で、地方公共団体の長の任命に係る者は特別職の地方公務員である。
３ 任命権者(Appointing Authorities)
（１）意 義＝ 任命権者とは、職員の任命・休職・免職・懲戒等の人事権を行使する権限を有する者のことである。have respectively the power to administer the appointment, temporary retirement, dismissal and disciplinary punishment, etc.
（２）任命権者の種類 ① 地方公共団体の長the heads（知事governer・市町村長mayor of municipality） ② 議会の議長the chairmen of the assemblies ③ 各種委員会（選挙管理委員会・代表監査委員・教育委員会・人事委員会・公平委員会the election administration committees, the representative inspection commissioners, boards of education, personnel commissions and equity commissions of the local public bodies） ④ 警視総監・道府県警察本部長 the Superintendent-General of the Metropolitan Police, the chief of the prefectural police ⑤ 市町村の消防長chiefs of the fire defense maintained jointly by special wards ⑥ 地方公営企業管理者
※ 労働委員会・収用委員会の事務局職員の任命権者は、知事である（各委員会ではない）。
※ 区市町村立学校の県費負担教職員の任命権者は、都道府県教育委員会である。
（３）権限の委任＝任命権者は、その権限の一部を、その補助機関である上級の地方公務員に委任することができる。（例：知事が副知事・局長に委任、都議会議長が議会局長に委任、など）
The appointing authorities mentioned in the preceding paragraph may delegate part of the power provided for in the same paragraph to those senior local public service personnel who are their auxiliary agencies.委任された範囲において委任者の権限は受任者に移転する。受任者は任命権の再委任はできない。
（４）長の総合調整権＝地方公共団体の長は、執行機関である他の任命権者に対し、人事行政に関する総合調整を行うことができる。 ① 組織、職員定数、職員の身分取扱について、他の任命権者に勧告することができる。② 組織、職員の身分取扱などに係る規則・規程の制定・変更の際の事前協議を義務づけている。
４ 人事委員会・公平委員会(Establishment of the Personnel Commission or Equity Commission)（１）意 義＝人事委員会・公平委員会は、地方公共団体における人事行政を民主的・科学的に行うために設けられた行政委員会であり、任命権者から独立した地位にある人事行政の専門的執行機関である。
（２）設置基準（いずれも当該地方公共団体が条例に基づき設置する）ア 都道府県、政令指定都市……人事委員会To, Do, Fu, or Ken and the designated cities mentioned in Article 252-19 paragraph 1 of the Local Autonomy Law (Law. No. 67 of 1947) shall set up by bylaw a personnel commission.
イ 特別区、人口１５万人以上の市……人事委員会又は公平委員会Cities other than the designated cities mentioned in the preceding paragraph, having the population of 150,000 or more (meaning the population according to the latest results of the national census public-noticed in the Official Gazette or the population census similar thereto; hereinafter the same) and the special wards shall set up a personnel commission by bylaws.
ウ 人口１５万人未満の市・町村・地方公共団体の組合……公平委員会The cities having the population less than 150,000, towns and villages, special wards and local public body association shall set up an equity commission by bylaws.※ 公平委員会を置く地方公共団体は、議会の議決を経て定める規約により、公平委員会を置く他の地方公共団体と共同して公平委員会を設置することができる。※ 公平委員会を置く地方公共団体は、議会の議決を経て定める規約により、他の地方公共団体の人事委員会（公平委員会ではない）に委託して、公平委員会の事務処理をさせることができる。The local public body setting up an equity commission may, by the stipulations enacted through resolution of the assembly, set up the equity commission jointly with another local public body setting up an equity commission, or entrust the duty of managing the affairs of equity commission under the provision of Article 8 paragraph 2 to the personnel commission of another local public body.

The personnel commission shall administer the following affairs:
①To investigate matters of personnel administration and to have charge of affairs concerning personnel records and to prepare statistical reports concerning personnel affairs;
②To make a continuous study on work hours and other working conditions and welfare and benefit systems, the system or compensation for accidents in line of duty and other systems concerning the personnel, and to submit the result thereof to the assembly or the head or the appointing authorities of the local public body;
③To state opinions to the assembly and the head of the local public body on the enactment, amendment, or abolition of bylaws concerning the personnel agencies and the personnel.
④To make recommendations to the appointing authorities on the operation of personnel administration;
⑤To administer the competitive examination and selection of the personnel and affairs relating thereto;
⑥To formulate and put into practice plans concerning the position classification;
⑦To supervise and control the payment of compensation to the personnel to the extent necessary to determine that persons are paid, compensated, or employed in compliance with this Law and with bylaws issued thereunder;
⑧To formulate over-all plans for the training and evaluation of work performance of the personnel.
⑨To examine and judge upon applications for action concerning compensation, work hours, and other working conditions of the personnel and adopt necessary measures
⑩To render(…に)する、する、与える、(…に)差し出す、提出する、(法廷で)言い渡す、下す、(…に)翻訳する、(文・絵で)(…を)表現する、描写する ruling or decisions on objections raised against the adverse actions toward the personnel.
ⅺ.Besides the affairs enumerated列挙された in the preceding items, to administer such affairs as have been placed within its powers in accordance with laws or bylaws.
☆The equity commission shall administer the following affairs;
①to examine and judge upon applications for action concerning the compensation, work hours and other working conditions of the personnel and adopt necessary measures;
②to render rulings or decisions on objections raised against the adverse actions toward the personnel.
（４）権限の委任＝人事委員会の権限は、その一部について、人事委員会規則で定めるところにより、当該地方公共団体の他の機関又は人事委員会の事務局長に委任することができる。（事務局長は再委任できない）人事委員会・公平委員会は、職員の苦情処理の事務を委員又は事務局長に委任することができる。
※ 人事委員会が委任できる主な権限（行政的権限の一部） ① 人事行政に関する調査、人事記録の管理、統計報告の作成 ② 勤務条件･研修･勤務評定･福利厚生等に関する研究と、その成果の議会･長･任命権者への提出③ 競争試験・選考の実施 ④ 給与の支払の監理 ⑤ 職員の苦情処理
（５）委 員＝人事委員会・公平委員会とも、委員３人で組織する。The personnel commission or equity commission shall be composed of three members.任期４年で、長が議会の同意を得て選任する。The members shall be appointed by the head of the local public body with the consent of the assembly（人事委員会の委員は常勤又は非常勤とし、公平委員会の委員は非常勤とするThe members of the personnel commissions shall serve either full-time or part-time, and the members of the equity commissions shall serve part-time.）委員には、欠格条項A person who falls under any of the items of Article 16 (Exclusive of item 2, 3, and item 5) or who has committed any of the offenses provided for in Chapter V and been sentenced to a punishment cannot become a member.政党所属制限In appointing the member, any two of them must not be members of the same political party.、罷免要件、服務規律、兼職禁止などが定められている委員３人のうちから委員長を選挙するThe personnel commission or equity commission must elect a chairman from among its members.委員長は委員会に関する事務を処理し委員会を代表する委員会は原則として、委員全員が出席しなければ会議を開くことができない
The personnel commission or equity commission cannot be in sesssion without the attendance of all of its members.が、十分な理由があるときは２人の委員で会議を開くことができる。Proceedings of the personnel commission or equity commission shall be decided by a majority of its members present.委員会の議事は出席委員の過半数で決する。
（６）事務局＝人事委員会に事務局と、事務局長その他の事務職員を置く。There shall be an executive office in the personnel commission and a chief of executive office and other administrative personnel in the executive office.（公平委員会は事務職員のみ置かれる）ただし、（２）イで人事委員会を置く地方公共団体は、事務局を置かずに事務職員のみを置くことができる。また、競争試験・選考を行う公平委員会は、事務局・事務局長を置くことができる。事務局組織は人事委員会が定め、事務職員は人事委員会・公平委員会が任免する。
